Changes to National Minimum Wage
NMW does not apply where students are undertaking work experience as part of a higher education course, provided that , as part of that course, they are required to attend a period of work experience which does not exceed one year.
Certain Government and European schemes and programs are also exempt from NMW. There are many other exemptions.
Employers who fail to comply with the NMW legislation commit a criminal offence with a maximum £5,000 fine and a criminal record if they:
• refuse or willfully neglect to pay workers a rate at least equal to the NMW
• fail to keep or preserve any records
• make, or knowingly cause or allow false entries to be made in any records
• produce or furnish false records or information
• intentionally delay or obstructs an officer
• refuse to answer any questions, provide or produce any information or documents when requested to do so by a officer
