Employment Tribunals

If your handwriting is bad you still make a claim at the Employment Tribunal.  Under the recent case of May v Greenwich Council (EAT/0102/10)  much of the claim form required a magnifying glass to read and the rest was hard to translate. Hidden assets

A survey conducted in 2009 suggests that 20% of couples who divorced during 2007/8 tried to conceal their income or assets from their spouse. The main culprit being the husband who would often use offshore companies, accounts and trusts to deceive their spouses and the Courts.

Spouses trying to uncover hidden assets often found themselves in danger of “misconduct” or “criminal litigation” proceedings. Today, the fraudsters find themselves face to face with Orders such as search orders, third party disclosure orders and gagging orders.

Break clauses in leases

A recent case made it clear that clear wording for conditions had to be followed.

In this case, the lease allow the tenant to break the term, provided he served notice both on the landlord and on a management company.

The tenant served a notice on the landlord but omitted to do so on the management company.  Therefore the notice was invalid and the tenant had to keep the lease for the rest of the term.

Employment - defective disciplinary procedure

An employer messes up a disciplinary procedure and comes to findings that it would not have done if the procedure had been conducted properly.

The employee suffers damage and loss of status as a result of being summarily dismissed.

Damages can be claimed “at large” and are not restricted to the notice period plus the period that the disciplinary procedure would have taken.

Termination of building agreement

Commercial property developer promises to build retail shopping centre; promises to pay money by instalments to a well known “anchor” retailer to take one of the units in order to attract other smaller retailers; but then fails to make the payment.

In the circumstances of this case, failure to pay one of the instalments did not entitle the retailer to terminate peremptorily the whole arrangement. Payment was not of the essence and the breach was not so fundamental as to amount to a repudiatory breach.
